New York County & Kings County Surrogate’s Court

Court-Appointed Neutral Fiduciary

For Contested and Complex Estates

In high-conflict or procedurally sensitive estate matters, appointment of a neutral fiduciary can stabilize administration and reduce litigation risk.

I serve as a court-appointed fiduciary in matters before:

  • New York County Surrogate’s Court (Manhattan)
  • Kings County Surrogate’s Court (Brooklyn)

I do not act as legal counsel.
All legal strategy, filings, and court advocacy remain with retained counsel.

My role is limited to disciplined estate administration in accordance with court orders and statutory requirements.

When Appointment Is Appropriate

A neutral administrator or trustee may be necessary where:

  • Beneficiaries are in active dispute
  • Allegations of undue influence or self-dealing exist
  • A nominated executor is unsuitable or unwilling
  • Temporary administration is required during litigation
  • Estate assets include complex or income-producing real property
  • Multi-party litigation makes family appointment impractical
  • Court confidence requires independent oversight

The objective is not strategic advocacy — it is procedural integrity.

Appointments Accepted

Subject to court approval, I may serve as:

  • Temporary Administrator
  • Administrator c.t.a.
  • Successor Trustee
  • Court-appointed fiduciary in contested proceedings

All appointments are undertaken with full recognition that fiduciary duties are personal, non-delegable obligations subject to judicial scrutiny.

Real Estate–Heavy Estates

A significant number of contested estates in Manhattan and Brooklyn involve:

  • Cooperative apartments
  • Condominiums
  • Mixed-use buildings
  • Rent-stabilized properties
  • Small multifamily assets
  • Commercial properties

Administration risk often arises in asset oversight rather than legal theory.

Operational management includes:

  • Securing and preserving property
  • Coordinating valuation
  • Managing income and expenses
  • Maintaining insurance and compliance
  • Working with managing agents
  • Coordinating sale where authorized

These responsibilities are executed in coordination with counsel and subject to court authority.

Working Relationship with Counsel

The structure is straightforward:

  • Counsel directs litigation strategy
  • Counsel prepares and files petitions
  • Counsel advises on statutory obligations
  • The fiduciary executes administration

Communication with beneficiaries is documented and professional.
No legal opinions are provided.
All contested matters are referred to counsel.

This separation protects both the estate and the attorney.

Procedural Discipline

Estate administration in New York County and Kings County requires:

  • Careful adherence to SCPA requirements
  • Timely filing of inventory and accountings
  • Clear recordkeeping
  • Segregated estate accounts
  • Bond compliance where required
  • Strict neutrality among parties

All actions are documented with the expectation of potential judicial review.

Risk Management

  • Fiduciary liability coverage maintained
  • Bonding obtained as required
  • No conflicts of interest
  • No self-dealing
  • No dual representation

Neutrality is essential in contested environments.
